OPWDD Eligibility Requirements and Qualifying Diagnoses

Self-Direction and every other OPWDD service starts with eligibility. Here is what New York law counts as a developmental disability, and what OPWDD needs to see.

Qualifying diagnoses

New York's Mental Hygiene Law defines a developmental disability as one attributable to:

  • Intellectual disability
  • Autism
  • Cerebral palsy
  • Epilepsy
  • Neurological impairment
  • Familial dysautonomia
  • Prader-Willi syndrome
  • Any other condition found to be closely related to intellectual disability, because it causes similar impairment of intellectual functioning or adaptive behavior, or needs similar treatment and services

The three other requirements

A diagnosis alone isn't enough. The disability must also:

  1. Have begun before age 22,
  2. Be expected to continue indefinitely, and
  3. Be a substantial handicap to the person's ability to function normally in society. In practice, OPWDD looks for significant limitations in adaptive behavior: everyday skills like communication, self-care, and getting around the community.

What OPWDD reviews

  • A psychological report with IQ testing and all summary scores
  • A standardized adaptive behavior assessment (essential for people with IQ scores above 60, which includes many autistic adults)
  • A developmental or social history showing the disability began before 22
  • Medical or specialist reports supporting the diagnosis, such as an autism diagnostic evaluation
  • A general medical report from the past 12 months

After eligibility
