SSI at 18: What Changes When Your Child Becomes an Adult

Many families never qualified for SSI when their child was younger because the parents' income was too high. At 18, that changes, and it's one of the most commonly missed opportunities in transition planning.

Parents' income stops counting

For children, Social Security "deems" part of the parents' income and resources to the child. That rule, called parental deeming, generally ends the month after the child turns 18. From then on, SSA looks at the young adult's own income and resources.

So even if you were turned down before, it may be worth applying once your son or daughter turns 18.

A new disability review

If your child already gets SSI, expect an age-18 redetermination. SSA re-evaluates the case using the adult definition of disability, which focuses on the ability to work, not the childhood standard. Some young adults who qualified as children are found ineligible as adults.

Send in current records: recent evaluations, school records from the last couple of years, and anything describing how the disability affects daily life and work. Don't assume SSA already has what it needs.

If the decision goes against you, you have 60 days to appeal. If you appeal within 10 days of the notice, you can usually ask for benefits to continue while the appeal is decided.

Living at home: the in-kind support rule

When an adult on SSI lives with family and doesn't pay toward household costs, SSA may count that free housing as "in-kind support and maintenance" and reduce the check. Two things help here:

  • Since September 30, 2024, food no longer counts as in-kind support. Only shelter costs do.
  • Paying a fair share of shelter costs, such as rent and utilities, can avoid the reduction. Keep a simple written agreement and records of payments.

Why it matters beyond the monthly check

In New York, people who receive SSI generally get Medicaid too, and Medicaid is what pays for most adult OPWDD services. For many families, SSI is part of the path into the adult service system, not just income.
